Section 1 - Online Store Terms

You represent that:

  • You are at least the age of majority in your jurisdiction (e.g., 19 in Alabama/Nebraska/Mississippi, 21 in Puerto Rico, 18 elsewhere in the U.S.), or
  • If under the age of 18, you have verifiable parental/guardian consent, and we may suspend your access until confirmed.

You may not:

  • Use the Services for illegal or unauthorized purposes (e.g., fraud, piracy).
  • Violate applicable laws (e.g., copyright, export controls).
  • Transmit viruses, malware, or destructive code.
    Breaches result in immediate Service termination and potential legal action, at our discretion.

Section 2 - General Conditions

We may refuse or terminate Service to anyone, anytime, for any reason (e.g., suspected abuse), without notice or liability, as a private entity.

Your content (excluding payment data) may transfer unencrypted across networks and be adapted technically. Payment data is encrypted via Shopify’s secure protocols (e.g., PCI-DSS compliant). You may not reproduce, sell, or exploit the Services or access without our express written consent. Unauthorized use may lead to civil or criminal penalties.

Section 3 - Accuracy, Completeness, and Timeliness of Information

Site content is "as is" for informational purposes. We’re not liable for inaccuracies, incompleteness, or outdated information. Use it at your own risk, verifying critical details elsewhere. Historical data is not current. We may modify content anytime without notice or obligation to update—monitor changes yourself.

Section 4 - Modifications to Services and Prices

Prices and Services may change without notice. We may suspend or discontinue any part of the Services at our sole discretion, without liability. Modifications or discontinuations don’t entitle you to compensation or remedies beyond our Refund Policy.

Section 5 - Products or Services

Products are sold exclusively online in limited quantities, subject to our Refund Policy We strive for accurate product displays but don’t guarantee your device reflects true colors or details.

We may:

  • Limit sales by person, region, or jurisdiction, case-by-case.
  • Cap order quantities.
  • Alter descriptions, pricing, or availability anytime.
  • Void offers where prohibited.
    No warranty exists that products or Services meet expectations or that errors will be corrected.

Section 6 - Accuracy of Billing and Account Information

We may refuse, limit, or cancel orders at our discretion (e.g., suspected reselling), notifying you via provided contact details if feasible. You must provide accurate, current billing and account information, updating it promptly to ensure transactions and communication. Failure to do so may result in order cancellation without refund outside our Refund Policy.

Section 7 - Optional Tools

Third-party tools (e.g., chatbots, sizing apps) are provided "as is," without warranties or liability. Use them at your own risk, subject to third-party terms. We may introduce new tools under these Terms without notice.

Section 8 - Third-Party Links

Third-party content or links on the Site aren’t our responsibility. We don’t endorse or warrant their accuracy, safety, or practices. Direct issues to third parties—we’re not liable for damages from their use.

Section 9 - User Comments, Feedback, and Submissions

Submissions (e.g., reviews, suggestions) grant us a perpetual, royalty-free, worldwide license to use, modify, or distribute them without compensation or confidentiality. We may monitor or remove objectionable content (e.g., illegal, offensive) but aren’t obligated to.

Your submissions must not:

  • Infringe third-party rights (e.g., IP, privacy).
  • Contain illegal, defamatory, or malicious material/code.
  • Misrepresent your identity.
    You’re solely liable for your submissions; we’re not responsible for them or third-party content.

Section 11 - Errors, Inaccuracies, and Omissions

We may correct errors (e.g., pricing typos) or cancel orders based on inaccurate data, even post-submission, without notice or liability beyond refunding payment. We’re not required to update content unless legally mandated.

Section 12 - Prohibited Uses

You may not use the Services to:

  • Break laws or solicit illegal acts.
  • Infringe our or others’ intellectual property.
  • Harass, defame, or discriminate.
  • Submit false data, malware, or spam.
  • Scrape, hack, or bypass security.
    Violators face immediate termination, legal action, and damages claims at our discretion.

Section 13 - Disclaimer of Warranties; Limitation of Liability

Services and products are "as is" and "as available," without warranties (express, implied, or statutory) of uninterrupted, secure, or error-free use, merchantability, fitness, or non-infringement. We may suspend Services anytime without notice.

We Are Resistance W.A.R., our affiliates, officers, agents, and suppliers are not liable for:

  • Any damages (direct, indirect, incidental, punitive, consequential—e.g., lost profits, data) from Service/product use, even if advised of risks.
  • Claims from errors, third-party actions, or interruptions.
    Liability is capped at the amount paid for the specific product/Service causing the claim, or $100 if no payment applies, to the fullest extent permitted by law. Where exclusions aren’t allowed, this cap applies.

Section 14 - Indemnification

You agree to indemnify, defend, and hold harmless We Are Resistance W.A.R., our affiliates, officers, agents, and suppliers from third-party claims (including legal fees) arising from your breach of these Terms, illegal acts, or rights violations. This survives termination.

Section 15 - Severability

Unlawful or unenforceable provisions are enforced to the fullest legal extent, with severed portions not affecting remaining Terms.

Section 16 - Termination

Pre-termination obligations survive. You may terminate by emailing w.a.r.weareresistance@gmail.com and ceasing use. We may terminate your access anytime for noncompliance (e.g., fraud, violation), without notice, retaining rights to amounts owed and barring re-access.

Section 17 - Entire Agreement

These Terms, with linked policies, are the sole agreement between us, superseding prior communications. Our non-enforcement isn’t a waiver. Ambiguities aren’t construed against us.

Section 18 - Governing Law and Dispute Resolution

These Terms are governed by California, U.S. law, excluding conflict rules. Disputes must first attempt resolution via email to w.a.r.weareresistance@gmail.com within 30 days of arising. Unresolved disputes go to binding arbitration in California under the American Arbitration Association (AAA) rules, not courts, except for injunctive relief we may seek in court. You waive class actions or jury trials.

For EU users, this doesn’t limit mandatory consumer rights (e.g., under EU Directive 2011/83/EU), but arbitration applies where permissible.

The latest Terms are here. We may revise them anytime, posting updates. Continued use is acceptance—check periodically.
